Jardine4Jobs - Terms of Use - January 2003

You should carefully read the terms under which you are permitted to use our service. These terms are complete and exclusive, and replace any previous terms.

1. Definitions:

1.1. 'Position' means a contract engagement or permanent employment position.

1.2. 'Candidate' means an individual making use of Jardine Motors Group for the purpose of seeking a Position.

1.3. 'CVs' means curricula vitae, resumes, company profiles and similar outlines of skills, education and experience.

1.4. 'Advertisement' means an advertisement for a Position placed.

1.7. 'Act' means the Employment Agencies Act 1973.

1.8. ''Regulations' means any current regulations made pursuant to the Act.

2. Jardine Jobs:

2.1. Jardine Jobs is an Internet service, designed to assist Candidates find Positions.

2.2. Jardine Jobs is owned and operated by Jardine Motors Group, Charter Court, Colchester, CO4 9XB.

2.3. Jardine Motors Group is registered under the Data Protection Act 1998.

3. As a Candidate you may:

3.1. Search Jardine4Jobs site for Positions, using the site's own search engine(s).

3.2. Upload your own CV (but not that of anyone else).

3.3. Register to request notification of future Positions by email.

4. By uploading your CV:

4.1. You warrant:

4.1.1. That it is submitted in good faith for the purpose of seeking a Position for you.

4.1.2. That it is in fact your own CV, and that it is honest and accurate.

4.1.3. That you are the sole owner of all rights in the nature of copyright in your CV as uploaded.

4.1.4. That you will keep your CV up to date by amendment as necessary from time to time.

4.1.5. That you will request the deletion of your CV once you are no longer seeking a Position, or use the automated tools to delete your own details.

4.1.6. That you will keep your personal details as provided to us on registration (including any postal and email addresses) up to date.

4.1.7. You grant us licence to modify it so far as is necessary to fit our standard format for CVs, but without altering its substance.

4.2. You acknowledge and agree that:

4.2.1. We have no control over the quality, accuracy, safety or legality of any Positions that may be advertised on Jardine4Jobs.

4.2.2. Jardine4Jobs may (but does not undertake to) automatically remove CVs 1 year after they have been uploaded. If after that period you continue to seek a Position it will be necessary for a fresh CV to be uploaded.

5. Liability

5.1. Jardine4Jobs IS AN INTERNET - AND SOFTWARE-BASED AUTOMATED SERVICE; IT IS PROVIDED 'AS IS', AND YOU ACKNOWLEDGE THAT IT IS NOT TECHNICALLY PRACTICABLE TO GUARANTEE SUCH A SERVICE TO BE ERROR-FREE. YOU AGREE THAT IF ANY ERRORS ARE FOUND TO EXIST THEY SHALL NOT CONSTITUTE A BREACH OF THESE TERMS, AND SHALL NOT GIVE RISE TO ANY LIABILITY ON THE PART OF Jardine Motors Group Limited.

5.2. Jardine4Jobs DOES NOT CHECK UPLOADED MATERIAL FOR VIRUSES, TIME AND LOGIC BOMBS, TROJANS OR BUGS. ALL MATERIAL IS DOWNLOADED AT THE USER'S RISK AND PlanetRecruit SHALL HAVE NO LIABILITY FOR ANY CORRUPTION OR ALTERATION OF DATA OR IMPORTATION OF ANY VIRUS, TIME OR LOGIC BOMB, TROJAN OR BUG AS A RESULT OF SUCH DOWNLOADING.

5.3. TO THE EXTENT PERMITTED BY THE APPLICABLE LAW, Jardine Motors Group Limited DISCLAIMS ALL WARRANTIES WITH RESPECT TO THE Jardine4Jobs SERVICE, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE.

5.4. Jardine Motors Group Limited SPECIFICALLY DISCLAIMS ALL AND ANY LIABILITY FOR LOSS OR DAMAGE OF ANY KIND AND HOWSOEVER ARISING, WHETHER DUE TO INACCURACY, ERROR, OMISSION, OR ANY OTHER CAUSE, AND WHETHER ON THE PART OF Jardine4Jobs OR ON THE PART OF ANY OTHER.

5.5. IN NO EVENT WILL Jardine Motors Group BE LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL LOSS OR DAMAGE WHICH MAY ARISE IN RESPECT OF THE Jardine4Jobs SERVICE, ITS USE, OR IN RESPECT OF OTHER EQUIPMENT OR PROPERTY, OR FOR LOSS OF PROFIT, BUSINESS, REVENUE, GOODWILL OR ANTICIPATED SAVINGS, EVEN IF Jardine Motors Group Limited HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS.

5.6. IN THE EVENT THAT ANY EXCLUSION CONTAINED IN THESE TERMS SHALL BE HELD TO BE INVALID FOR ANY REASON AND Jardine Motors Group Limited BECOMES LIABLE FOR LOSS OR DAMAGE THAT MAY LAWFULLY BE LIMITED, SUCH LIABILITY SHALL BE LIMITED TO £100.

5.7. These limitations on liability are intended to benefit not only Jardine Motors Group but also all our employees agents and information providers.

6. Copyright and Intellectual Property Rights

6.1. The copyrights in CVs on Jardine4Jobs are owned by the Candidates to whom they relate.

6.2. The copyrights in Advertisements on Jardine4Jobs are owned by Jardine Motors Group Limited.

6.3. The copyrights and database rights in (1) the collections of CVs and (2) the collections of Advertisements on Jardine4Jobs are owned by Jardine Motors Group Limited.

6.4. All rights in CVs and in Advertisements carried by Jardine4Jobs (meaning rights in the individual items, and also in the collections of items) are reserved to the respective owners thereof, save to the extent that rights are expressly granted by these User Terms.

6.5. All copyrights and other intellectual property rights in any other items on Jardine4Jobs (including text, graphics, images, logos, button icons, HTML code and other software) ("Content") are reserved to (and are the sole property of) Jardine Motors Group Limited

7. Any use of the Jardine4jos site beyond such as is expressly permitted by these User Terms is prohibited and unlawful. In particular, the following are not permitted:

7.1. Any form of automated access to or use of Jardine4Jobs (meaning access or use other than by an individual using an unmodified web browser of a type in general use by consumers)

7.2. Attempts to decipher, decompile, disassemble or reverse engineer any of the software comprising the Jardine4Jobs site.

7.3. Jardine4Jobs is a trade mark and is the sole and exclusive property of Jardine Motors Group.

8. Miscellaneous:

8.1. We may email you with information updates, news.

8.2. Our Privacy Policy sets out in more detail our policies on the use of data provided by or collected by us.

8.3. Jardine Motors Group Limited reserves the right at its sole discretion to remove material from Jardine4jobs website

8.4. Jardine Motors Group Limited reserves the right at its sole discretion to deny access by any individual to Jardine4Jobs where it considers it necessary or appropriate to do so.

8.5. Where we incur liability or loss as a result of any wrongful or unlawful act by you in connection with your use of Jardine4Jobs, you agree to indemnify us against any such liability or loss.

8.6. By using Jardine4Jobs you accept all of these User Terms, supersede all prior agreements. No oral or written information given by us or on our behalf shall create a warranty or collateral contract, or in any way increase the scope of our liability, and you may not rely on any such information. Except as otherwise provided, no addition, amendment or modification of these User Terms shall be effective, unless in writing and signed or accepted by us. We have the right to modify these User Terms at any time by notice , and if you continue to use Jardine4Jobs thereafter you will be deemed to have accepted any such modification.

8.7. These Terms shall be governed by the laws of England & Wales, and the courts of England & Wales shall have exclusive jurisdiction in all matters arising.
